The following Copyright Policy outlines the usage, rights, and restrictions of all photographic and video works created, published, or distributed by Pathos Imagery.
By accessing, using, or purchasing from Pathos Imagery, you acknowledge and agree to the terms set forth in this policy.
Ownership & Copyright
Copyright Holder: All photographs, videos, and visual works created by Paul Jaskulski and published under the brand Pathos Imagery are the exclusive property of the photographer and are protected by copyright law.
Copyright Ownership: All content, including but not limited to images, videos, raw files, edited works, and digital formats, remain the sole property of Paul Jaskulski unless otherwise explicitly stated in writing.
Licensing & Usage Rights
1. Usage License:
Upon purchasing or receiving photographs or videos from Pathos Imagery, you are granted a limited, non-exclusive, non-transferable license to use the images or videos for personal or commercial purposes, as agreed in the contract or invoice.
• For personal use, this may include prints, social media sharing, and personal displays.
• For commercial use, this may include advertising, websites, print materials, etc., but may be subject to additional licensing agreements or fees.
2. School Projects & Educational Use:
I grant permission for photographs from Pathos Imagery to be used in non-commercial educational contexts, including but not limited to school projects, assignments, presentations, and personal portfolios. This use must be for educational purposes only, and images may not be used for commercial gain or public distribution. Proper credit must be given to Pathos Imagery when used in any educational or school-related work.
3. Video Restrictions:
Any videos posted by Pathos Imagery on social media, websites, or other platforms are the exclusive property of Paul Jaskulski. Videos may not be downloaded, repurposed, or used in any form without prior written permission. These videos are not for use in any commercial, promotional, or personal projects unless explicitly authorised by Paul Jaskulski. Any unauthorised use, including sharing, redistribution, or modification, will result in legal action.
4. Restrictions on Usage:
• Resale or Redistribution: You are prohibited from reselling, redistributing, or sublicensing the photographs or videos to third parties unless explicitly authorised in writing by Paul Jaskulski.
• Alterations: You may not modify, alter, or create derivative works from the images or videos (including cropping, filters, or changes to colour or content) without permission, except where allowed for specific use cases (e.g., resizing for personal use).
• Unauthorised Commercial Use: Unauthorised use for advertising, promotional materials, merchandise, or any form of commercial exploitation requires a separate licensing agreement.
Copyright Infringement
Consequences of Infringement: Any unauthorised use of the photographs or videos without proper licensing or permission will be subject to legal action, which may include claims for damages, legal fees, and injunctive relief.
Client Deliverables
• File Delivery: Files provided to clients, whether in print, digital format, or video, remain the property of Paul Jaskulski / Pathos Imagery. Clients may only use the delivered files within the scope of their agreed-upon license.
• Exclusivity & Copyright Transfer: Copyright is not transferred to clients unless explicitly agreed upon in writing. Clients may request a transfer of rights for a specific image or video, but this will be subject to an additional fee and agreement.
Fair Use & Attribution
• Attribution: If you are sharing Pathos Imagery’s work (photos or videos) on social media or other public platforms, proper credit must be given to Pathos Imagery, including the name and a link to the website or portfolio where applicable.
• Fair Use: Certain uses of photographs and videos may qualify under "fair use" provisions, such as for commentary, criticism, or educational purposes, but any other uses require explicit permission.
