SECTION 1 – Physical Products & Payments

By accessing this website and placing an order, you agree to the following terms and conditions.

Website Platform

This website is hosted by Squarespace, which provides the online platform used to display and sell photography prints.

Intellectual Property

All photographs displayed on this website are the intellectual property of the photographer and are protected under UK and international copyright laws.

Purchasing a print does not transfer copyright ownership. Images may not be reproduced, distributed, published, or used commercially without written permission from the photographer.

Orders

All orders are subject to availability and confirmation of payment.

I reserve the right to refuse or cancel an order where necessary, including in cases of:

• pricing errors

• product availability issues

• suspected fraudulent activity

• payment processing issues

Pricing

All prices are listed in GBP (£) unless otherwise stated.

Prices may change at any time without prior notice.

Payments

Payments are securely processed by Stripe. Payment card details are handled directly by Stripe’s secure payment system and are not stored on this website.

By completing a purchase, you agree to Stripe processing your payment in accordance with their own privacy and security policies.

Print Appearance

Every effort is made to accurately display photographs and colours on this website. However, colours may appear slightly different depending on individual monitor settings, screen calibration and device displays.

Minor colour variations between what you see on screen and the printed product are normal and do not constitute a defect.

Order Processing

Orders are typically processed up to 5 business days before dispatch.

Processing times may vary during busy periods or holidays.

Shipping

Orders are shipped using Royal Mail Tracked 48.

This service includes:

• end-to-end tracking

• delivery confirmation

• delivery photograph confirmation 

Tracking information will be provided once your order has been dispatched.

Royal Mail Tracked 48 deliveries typically arrive within 2 business days after dispatch, although this timeframe cannot be guaranteed.

Responsibility for Delivery

Once an order has been dispatched, delivery services are handled by Royal Mail. While I will assist in resolving any delivery issues, delays caused by postal services are outside my control.

If tracking confirms a parcel has been delivered to the correct address, responsibility for the parcel transfers to the customer.

Packaging

All prints are carefully packaged to protect them during transit.

Website Accuracy

While I aim to ensure that all information on this website is accurate and up to date, errors may occasionally occur. I reserve the right to correct any errors or inaccuracies without prior notice.

SECTION 2 – Photography Services

1. Overview

These terms apply to all photography services provided by Pathos Imagery, made through the website or via invoice payment, including but not limited to event photography, engagement sessions and property/real estate photography. By booking a session, the client agrees to the terms outlined below.

2. Booking & Payment

  1. A booking is confirmed only once a deposit or full payment has been received. This secures the requested date and time for the photography service.

  2. The remaining balance, if applicable, must be paid before or on the day of the scheduled session unless otherwise agreed in writing.

  3. Pathos Imagery reserves the right to decline or cancel bookings if payment terms are not met.

3. Deposits

  1. A 20% deposit of the service price is required to secure a booking. Deposits are non-refundable as they reserve time and availability for the client’s session.

  2. If the client cancels the booking, the deposit will not be returned unless otherwise agreed in writing.

4. Rescheduling & Cancellations

  1. Clients may request to reschedule their session with at least 14 days’ notice. Rescheduling requests are subject to photographer availability.

  2. If a client cancels a confirmed booking, any deposit paid will be forfeited.

  3. Pathos Imagery reserves the right to reschedule a session and shall not be liable for failure to perform services where such failure is due to circumstances beyond reasonable control, including but not limited to severe weather, natural disasters, government restrictions, venue closures, photographer illness, transportation disruption, or sudden equipment failure. In such cases, an alternative date will be offered. If a mutually agreeable date cannot be found, Clause 3.(1) applies.

5. Client Responsibilities

  1. Clients are responsible for:

  • Ensuring timely arrival at the agreed location

  • Obtaining permission to photograph at the chosen venue or property

  • Ensuring that all relevant participants are aware of the photography session

  • Clients agree to cooperate with the photographer to achieve the best possible results during the session or event. Pathos Imagery cannot be held responsible for missed images due to lack of cooperation from participants, guests, or venue staff.

2. Pathos Imagery cannot be held responsible for missed shots due to delays, restricted access, or venue limitations.

6. Artistic Style

  1. Clients acknowledge that they are hiring Pathos Imagery for its creative style and professional judgment. Final images will be edited according to the photographer’s artistic style.

  2. Specific editing requests may be considered but cannot be guaranteed.

  3. Minor adjustments may be accommodated at the photographer’s discretion. Extensive retouching or additional editing will incur an additional fee.

7. Image Delivery & Storage

  1. Photographs will be delivered digitally unless otherwise agreed.

  2. Typical delivery times vary depending on the service provided but generally fall within 7–14 days after the session. During busy periods, delivery times may vary slightly.

  3. Pathos Imagery does not provide RAW or unedited image files unless explicitly agreed in writing prior to the photography session. Only professionally edited images selected by the photographer will be delivered to the client. 

  4. Images will usually be provided through a private password-protected digital gallery at www.pathosimagery.co.uk/client, unless agreed otherwise.

  5. Pathos Imagery will retain delivered photographs for approximately 30 days following delivery. Clients are responsible for downloading and securely storing their images. Pathos Imagery does not provide long-term storage or file archival.

8. Image Usage & Licensing

All photographs taken by Pathos Imagery remain the intellectual property and copyright of the photographer.

Clients receive a license for personal or agreed commercial use depending on the service booked:

  1. Engagement & Personal Sessions
    Clients receive a personal-use license allowing them to share images online, print them for personal use and store them digitally.

  2. Event Photography
    Images may be used for personal or promotional purposes depending on the agreement made at the time of booking.

  3. Property / Real Estate Photography
    Images may be used by the client for marketing the specific property photographed. Images may not be resold, transferred for unrelated commercial use or reused for other listings, marketing campaigns, or third parties without permission.

9. Property Photography

  1. Property Permissions
    The client is responsible for obtaining all necessary permissions to photograph the property and any items within it. This includes artwork, designs, trademarks, or other copyrighted material that may appear in the photographs. Pathos Imagery is not responsible for any claims arising from the use of images containing such materials.

  2. Property Preparation

    Clients are responsible for the preparation of the photography session, ensuring the property is clean, staged and ready for photography at the scheduled time. Pathos Imagery is not responsible for moving furniture, staging rooms, or altering the property beyond minor adjustments necessary for photography.

  3. Travel & Location Access

    The client is responsible for ensuring the photographer has safe and reasonable access to the location. Any travel fees or parking charges will be agreed in advance where applicable.

10. Event Schedule, Overtime & Coverage

  1. Photography coverage will begin and end at the times agreed during booking. If the event runs beyond the scheduled coverage time, additional photography may be available at the photographer’s discretion and may incur an overtime fee. 

  2. Pathos Imagery will make reasonable efforts to capture key moments during an event, however, specific images or moments cannot be guaranteed due to factors including, but not limited to; timing, lighting conditions, guest cooperation, changes made by the client, or venue restrictions. In such cases, Pathos Imagery will not be responsible for missed photographs.

11. Photographer Safety

Pathos Imagery reserves the right to cease photography services if the photographer feels unsafe or if conditions pose a risk to equipment or personal safety.

12. Portfolio & Marketing Use

  1. Unless agreed otherwise in writing, Pathos Imagery reserves the right to use photographs taken during sessions for portfolio display, website content, social media and marketing purposes.

  2. Clients who wish to keep images private should notify Pathos Imagery before the session.

13. Limitation of Liability

While every effort is made to provide a professional and reliable service, Pathos Imagery shall not be held liable for circumstances beyond reasonable control, including but not limited to severe weather, natural disasters, government restrictions, venue closures, photographer illness, transportation disruption, or sudden equipment failure. In the unlikely event that photographs are lost, damaged, or cannot be delivered due to technical failure or unforeseen circumstances, Pathos Imagery’s liability will be limited to the amount paid for the photography service.

14. Acceptance of Terms

By booking photography services with Pathos Imagery, the client acknowledges that they have read, understood and agreed to these Photography Services Terms.

15. Governing Law

These terms are governed by the laws of England and Wales.
